All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights.

Whilst LES Shop Ltd takes care to ensure the accuracy of the Content, to the extent permitted by law, no legal liability is assumed for nor does it warrant that the information contained on this Website is accurate or complete. We cannot guarantee these web pages will be free from errors or that availability will be uninterrupted. LES Shop Ltd hereby expressly disclaims and excludes all express and implied warranties terms or conditions not stated herein, so far as such exclusion or disclaimer is permitted under the applicable law. This excludes all liability to any person for any loss or damage caused by any errors or omissions, whether such errors or omissions result from negligence, accident or any other cause but this disclaimer is without prejudice to any claims for fraudulent misrepresentation, personal injuries or death.

  1. Electronic Communications

When you send an email, text message and any other communication from your desktop or mobile device to us, you are communicating with us electronically. We will communicate with you electronically via email or by posting communications on our website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, unless mandatory applicable laws specifically require a different form of communication.

The Content of this website and all copyright and other intellectual property rights therein belong to LES Shop Ltd or its Content providers. You are hereby granted permission to access the Site and print a copy of the Content as a record of your visit. All other use of the Site and its Content, including modification, publication, transmission, creation of derivative works, incorporation into another website or reproducing the Site or the Content (whether by linking, framing or any other method) is not permitted without prior express written consent of the Foundation Secretary & Treasurer.

  1. Our liability

We will do our utmost to ensure that the availability of LES Shop Ltd will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to our website may also be occasionally suspended or restricted to allow for repair, maintenance or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

  1. Children

We do not sell products for purchase by children. We sell children’s products for purchase by adults. If you are under 18 you may only enter into a contract of sale with the involvement of a parent or guardian.

  1. Conditions of Sale

Your order is an offer to LES Shop Ltd to buy the product(s) in your order. When you place an order to purchase a product we will send you a message confirming receipt of your order (the ‘Order Confirmation’). The Order Confirmation is acknowledgement that we have received your order, and does not confirm acceptance of your offer to buy the product(s) or the service ordered. We only accept your offer and confirm the contract of sale when we dispatch the product to you and send an email confirming to you that we’ve dispatched the product to you (dispatch confirmation). Your contract is with LES Shop Ltd. If you would like to cancel the order any time between receiving the order confirmation and dispatch confirmation, please contact LES Shop Ltd via email or telephone.

  1. Supply of Goods

In the unlikely event that we are unable to supply your goods within 30 days, we will inform you immediately and advise you of the expected delivery date. Outstanding orders/items can be cancelled at any time. In the event of any goods delivered by us being damaged in transit, deficient of items shown on the delivery note or failing to match the items ordered by you, then such details must be notified by you to us within 7 working days of receipt of the said delivery. If we receive no such notification the customer will be deemed to have accepted the items as satisfactory. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the company’s appointed courier.

  1. Online Payments

You may complete an online purchase as a guest or by registering for a website account with your unique password. Payment for all goods and services is required in advance, and we will include the prevailing rates of UK value added tax (VAT) where appropriate. All prices are quote in UK pound Sterling. Any currency conversion costs or other charges or costs incurred by you when making a payment or in processing a refund, shall be borne by you and shall not be deducted from any amount payable to LES Shop Ltd.

We are pleased to accept orders online using your credit/debit card. Online transactions via credit/debit card are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, JCB, Switch, and Maestro. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.

The web price includes VAT at 20% where applicable. To calculate the tax free value of the good where applicable divide the price shown by 1.2.

Where a mistake has been made by LES Shop Ltd, the purchaser may cancel the contract, and receive a refund in accordance with the Refund Policy set out below.

We cannot accept liability for a payment not reaching the correct account due to you quoting an incorrect account number or incorrect personal details. Neither can we accept liability if payment is refused or declined by the credit/debit card supplier for any reason.

If the card supplier declines payment LES Shop Ltd is under no obligation to bring this fact to your attention. You should check with your bank/credit/debit card supplier that payment has been deducted from your account.

Every effort is made to keep the online payment facility up and running smoothly. However, the LES Shop Ltd takes no responsibility for, and will not be liable for, the online payment facility being temporarily unavailable due to technical issues beyond our control.

  1. Products, Prices & Content

Whilst every effort is made to ensure the pictures and colours depicted on the site match as closely, some colours may vary due to technical limitations.

Prices, product descriptions and specifications are routinely checked and products are updated on a regular basis. Whilst every effort is made to ensure their accuracy, no responsibility will be accepted by LES Shop Ltd for any errors or omissions.

We reserve the right to alter our prices and specifications without notice.

  1. Ownership of Goods

All items supplied to our customers remain the property of LES Shop Ltd, until final payment of all sums owing in respect of those goods, has been received in full by us.

  1. Delivery

Online purchases can be collected from the school shop or delivered to a UK address. Items will be sent by Royal Mail 2ndClass Post or Standard Parcel Post with an estimated delivery time of 5 – 7 working days. Please note, Grammar and High School pupils may visit the school shop during their lunch break from 1.30pm in order to collect online purchases. All goods are subject to availability. Delivery charges are listed below and based on the value of the order:

  1. Returns and Exchanges

We want you to be entirely satisfied with every purchase made from us and are proud of the quality, range and advise that we offer.

We are however happy to accept returns for refund or exchange, providing goods are in their original condition. Please note, you will have to pay the return cost of postage.

  1. Refund Policy

  • Please contact us within 7 working days from the day after the delivery day
  • Contact us via telephone, email or in writing
  • Return products to us with the products in the original packaging and labels, within 30 days of receipt
  • All goods to be in a new and unused condition together with a copy of your original receipt
  • We recommend that all items returned to us via post be sent using Royal Mail special delivery with insurance paid as a minimum
  • If you feel the goods are faulty please contact us immediately and we will then contact you to resolve the matter

Any personal information provided to us on this Site is controlled by the Loughborough Schools Foundation (“the Foundation”), 3 Burton Walks, Loughborough Leicestershire LE11 2DU. LSF Shop Ltd does not store any payment card details and follows best practice to secure customer information in accordance with Data Protection law.

How do we use the Personal Information gathered?

We use the personal information you supply to handle orders, deliver products and services, process payments, communicate with you about orders, products, services and promotional offers, update your records and generally maintain your accounts with us. We also use this information to improve our store and platform, prevent or detect fraud or abuses of our website and enable third parties to carry out technical, logistical or other functions on our behalf. Information about our customers is an important part of our business and we are not in the business of selling it to others. Please note, third parties are defined as those engaged in a business relationship with LSF Shop Ltd. Upon termination of this business relationship, these terms will automatically terminate provided, however, that their obligations in relation to the Confidential information will survive for five years following the termination. Nothing in these Terms limits the parties’ rights and obligations arising at general law in respect of the Confidential Information following termination of these Terms.

We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Conditions of Use and other agreements; or protect the rights, property or safety of LSF Shop Ltd, our users or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction. How Secure is My Personal Information

We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.

All payment details which are entered through the online payment facility are encrypted when the purchaser making payment enters them. Communications to and from the Service Provider’s site are encrypted, protecting the online transactions with Secure Sockets Layer protocol (SSL). Seeing the SSL padlock in the browser indicates:

  • That the purchaser has a secure (encrypted) link with the website.
